5D Profile Assessment Terms of Use

This page sets forth the conditions for use of the 5D Profile Assessment provided by Strategic Human Capital Consultant, including the handling of assessment results, copyright and intellectual property rights, restrictions on the use of information posted on this website, the handling of personal information, and disclaimers.

These Terms of Use (the “Terms”) set forth the conditions governing the use of the “5D Profile Assessment” and all related services provided by Strategic Human Capital Consultant (the “Company”) (collectively, the “Service”).
Any corporation, organization, group, or assessment participant using the Service shall use the Service only after agreeing to these Terms.

Article 1 (Application)

These Terms apply to the use of the Service between the Company and all parties who use the Service, including contracting companies, client companies, organizations, assessment participants, and any other users.
If separate terms are established between the Company and a contracting company by way of a contract, application form, memorandum, or any other written or electronic record, such individual terms shall prevail over these Terms.

Article 2 (Content of the Service)

The Service analyzes personality traits, emotional traits, thinking traits, behavioral traits, work values, and other items using the Company’s prescribed methods based on response data submitted by assessment participants and other information specified by the Company, and displays, reports, or otherwise provides the results.

The content provided through the Service is intended to serve as objective reference material or supporting material for use in corporate talent understanding, talent development, dialogue facilitation, placement consideration, organizational management, hiring, promotion, advancement, and other HR-related decisions.
However, the results of the Service are not intended to serve as the sole basis for any such decision, and the contracting company or user shall make a comprehensive judgment based on interview results, work experience, job performance, qualifications, work status, organizational circumstances, and other relevant factors.

Article 3 (Service Agreement)

Use of the Service shall be based on a separate agreement between the Company and the contracting company, the application details, and other conditions specified by the Company.
Assessment participants shall use the Service within the scope of these Terms in accordance with the instructions of the contracting company or the guidance of the Company.

Article 4 (User Environment and Management)

Users shall, at their own responsibility and expense, prepare the devices, communication lines, software, browser environment, and any other usage environment necessary for use of the Service.
Where an ID, password, assessment URL, or any other authentication information is issued, the user shall manage it appropriately and shall not allow any third party to use it.

Article 5 (Prohibited Conduct)

In using the Service, users shall not engage in any of the following acts.

1. Registering or submitting false information
2. Using the Service while impersonating another person
3. Interfering with, or engaging in conduct that may interfere with, the operation of the Service
4. Unauthorized access, reverse engineering, analysis, alteration, scraping, or any similar acts
5. Using the results, content, or materials of the Service beyond the scope of the contractual purpose
6. Infringing the rights or interests of the Company or any third party
7. Violating laws, regulations, or public order and morals
8. Any other conduct that the Company deems inappropriate

Article 6 (Handling of Assessment Results)

Assessment results are based on response tendencies at the time of the assessment and other standards prescribed by the Company, and may change due to subsequent environmental changes, psychological state, experience, or other factors.

Contracting companies and assessment participants shall use assessment results at their own responsibility, with an understanding of their nature, when interpreting and applying them.
The scope of access to assessment results, the parties to whom they are provided, and the method of provision shall be governed by separate conditions established between the Company and the contracting company.

Article 7 (Copyright and Intellectual Property Rights)

All copyrights and other intellectual property rights relating to the Service, this website, and all information, materials, and content provided by the Company belong to the Company or to third parties holding legitimate rights.

This includes, without limitation:
・The names, descriptive texts, columns, published text, images, charts, logos, designs, and layouts of the 5D Profile Assessment and the Executive Profile Assessment
・Assessment questions, question structure, question wording, evaluation items, judgment criteria, analytical logic, and feedback text
・Assessment result screens, reports, PDF reports, sales materials, downloadable materials, training materials
・Systems, programs, algorithms, screen designs, database structures, output formats, and all other expressions, structures, and deliverables related to the Service

Without the Company’s prior written consent, users are prohibited from reproducing, republishing, using beyond the scope of lawful quotation, modifying, adapting, distributing, selling, publicly transmitting, making transmittable, reusing, converting into training materials, using for commercial purposes, converting into AI training data, or diverting for use in similar services.

A contracting company may use assessment results and materials provided by the Company only within the scope of internal use based on its contract with the Company, and shall not, without the Company’s prior consent, re-provide, redistribute, resell, publicly post, use in external training, or otherwise use them beyond the contractual purpose.

If a user violates this Article, the Company may take any necessary measures, including suspension of use, termination of contract, demands for deletion, injunctive relief, and claims for damages.

Article 8 (Restrictions on Use of Website Content)

Text, images, charts, descriptions, columns, service information, PDFs, and all other content posted on this website are also included within the scope of copyright and intellectual property rights described in the preceding Article.

Except for quotations permitted by law, users may not reproduce, copy, distribute, modify, or make secondary use of such content without the Company’s permission.
When making a lawful quotation, the source must be clearly indicated within the legally permitted scope, and the quoted portion must remain subordinate to the user’s own content.

Article 9 (Handling of Personal Information)

The Company shall handle personal information acquired in connection with the Service in accordance with its separately established Privacy Policy.
Where a contracting company provides information about assessment participants to the Company, the contracting company shall, at its own responsibility, provide the necessary notices and take other appropriate measures.

Article 10 (Suspension or Modification of the Service)

The Company may suspend, interrupt, or modify all or part of the Service where there is a reasonable reason to do so, including maintenance, incident response, specification changes, or changes in the external environment.
Even if damage is incurred by a user or a third party as a result, the Company shall not be liable except in cases of willful misconduct or gross negligence on the part of the Company.

Article 11 (Disclaimer)

In analyzing the Service, the Company endeavors to take into account psychology, cognitive science, sociology, and other relevant knowledge.
However, assessment results are reference information that may vary depending on the participant’s responses, condition at the time of response, usage environment, and other factors, and the Company does not guarantee their completeness, absolute accuracy, fitness for any specific HR decision, or the achievement of any specific result.

The Company shall not be liable for any damages arising from a user’s use of, or inability to use, the Service, except in cases of willful misconduct or gross negligence on the part of the Company.

Article 12 (Suspension of Use, etc.)

If a user violates these Terms, or if the Company determines that the user is likely to interfere with the proper operation of the Service, the Company may, without prior notice, take any necessary measures, including suspension of use of the Service, suspension of the provision of assessment results, and invalidation of IDs.

Article 13 (Amendment of the Terms)

The Company may amend these Terms as necessary. Any amended terms shall become effective when published on this website or otherwise announced by the Company in a manner designated by the Company.

Article 14 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan.
In the event of any dispute relating to these Terms or the Service, the court having jurisdiction over the location of the Company shall have exclusive jurisdiction as the court of first instance by agreement.
